By downloading or using Ocean Insight ("the App"), you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the App.

1. Provider

Ocean Insight is developed and operated by Tom Göckeritz, Kaulsdorfer Str. 8a, 12621 Berlin, Germany (tom@attomic.de).

2. Scope of Use

Ocean Insight is a nature education mobile application ("App") that presents ocean species information, daily challenges, achievements, and prehistoric trophies. The App is available for iOS (App Store) and Android (Google Play).

3. Free and Premium Features

3.1 Free Tier

The App is free to download. Free users have access to:

  • The daily species discovery feature
  • Standard achievements
  • IUCN-verified species facts

The free version displays advertisements served by Google AdMob. Personalised advertising requires your explicit consent, which you can grant or decline through the consent dialog on first launch. You may withdraw consent at any time in the App's settings.

3.2 Premium ("Ocean Insight Premium")

A Premium subscription or one-time purchase unlocks:

  • Ad-free experience
  • Prehistoric trophy category (Urzeit-Trophäen)
  • Additional achievements and exclusive content
  • Future Premium features as released

Premium is purchased through the App Store or Google Play and is subject to their respective terms.

4. In-App Purchases

In-app purchases are processed exclusively by Apple (App Store) or Google (Google Play). All prices include applicable VAT; the respective store operator is the seller and contractual counterparty. Subscriptions can be cancelled at any time via the account settings of the respective store; cancellation takes effect at the end of the current billing period.

4.1 Right of Withdrawal (EU Consumers)

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Tom Göckeritz, Kaulsdorfer Str. 8a, 12621 Berlin, Germany, tom@attomic.de) of your decision to withdraw by an unequivocal statement (e.g. a letter sent by post or email). To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal. If you withdraw from this contract, we will reimburse you all payments received from you without undue delay and not later than 14 days from the day on which we are informed about your decision to withdraw.

Early termination of the right of withdrawal (Art. 16(m) Consumer Rights Directive / § 356(5) BGB). For contracts on the supply of digital content not delivered on a tangible medium, the right of withdrawal expires once we have begun performance after you have (a) given your express prior consent to begin performance during the withdrawal period and (b) acknowledged that you thereby lose your right of withdrawal. This acknowledgement is collected in the App's purchase dialog before Premium content is unlocked.

Refund requests for store-processed purchases may also be addressed directly to Apple or Google, as they act as the seller.

5. Age Recommendation

Ocean Insight is rated suitable for all ages with adult supervision recommended for children under 8. The App does not require registration or an account. Parents and guardians are encouraged to supervise children's in-app purchase activity.

6. License Grant

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited licence to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the App or its content
  • Reverse-engineer, decompile, or disassemble the App
  • Use the App for commercial purposes
  • Transfer your licence or account to another person
  • Use the App in any way that violates applicable law

7. Intellectual Property

All content within the App — including species illustrations, audio narration, text, UI design, and the Ocean Insight name and logo — is owned by Tom Göckeritz or its licensors and is protected by applicable intellectual property laws. IUCN data is used under the IUCN Red List Terms and Conditions.

8. Disclaimer of Warranties

The educational content in Ocean Insight is provided "as is" and for informational purposes only. While we strive for accuracy using IUCN-verified data, we make no warranties, express or implied, as to the completeness, accuracy, or fitness for a particular purpose of any species information. Scientific classifications may change; always consult primary sources for critical research.

The App is provided without warranty of uninterrupted availability or freedom from errors.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Tom Göckeritz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data or interruption of use. Our total liability shall not exceed the amount paid by you for the App in the twelve months preceding the claim.

10. Changes to the App and Terms

We may amend these Terms for good cause (e.g. new legal requirements, changed functionality, adapting to case law). For material changes, we will notify you in the App or by email at least 30 days before the changes take effect. If you do not agree to the changes, you may uninstall the App before they take effect; Premium entitlements already acquired remain unaffected.

11. Termination

We reserve the right to suspend or terminate your access to the App if you breach these Terms. You may stop using the App at any time by uninstalling it.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The exclusive place of jurisdiction for any disputes arising from or in connection with these Terms is Germany, to the extent permitted by law.

If you are a consumer resident in the EU, you benefit from mandatory consumer protection provisions of the law of your country of residence.
